Product Warranty Statement
3-year voluntary product warranty for smartathome branded products
Smart@Home Handels GmbH grants consumers a voluntary product warranty of three years on smartathome branded products from the date of purchase or handover of the goods, unless otherwise provided below.
This warranty applies in addition to your statutory warranty rights. Your statutory warranty rights against us as the seller are not limited by this warranty. You can assert statutory warranty rights independently of this warranty.

Warranted products
The warranty applies to smartathome branded products purchased via shop.smartathome.at or through sales channels authorised by Smart@Home.
For products from other manufacturers, only their respective warranty terms apply, provided such warranties are offered. Statutory warranty rights against Smart@Home as the seller remain unaffected.
Warranty period
The warranty period is three years from the date of purchase or handover of the goods to the end customer. The proof of purchase, the invoice or another suitable proof is decisive.
A warranty service does not extend the original warranty period and does not cause it to start anew, unless otherwise mandatorily required by law.
Scope of the warranty
The warranty covers material and manufacturing defects that occur under normal, intended use of the product.
In a warranty case, we will provide one of the following services at our discretion:
- repair of the product;
- replacement with an identical product;
- replacement with an equivalent product if the original product is no longer available;
- another reasonable solution in consultation with you, if repair or replacement is not possible or is disproportionate.
Warranty exclusions
The warranty does not apply to damage or defects caused by:
- improper use;
- failure to observe operating, assembly or installation instructions;
- improper installation, maintenance or commissioning;
- misuse, overloading or use contrary to the intended purpose;
- drops, impacts, accidents or external force;
- moisture, water, fire, overvoltage, lightning strike or other external influences;
- unauthorised repairs, modifications or alterations by third parties;
- natural wear and tear;
- consumable and wear parts such as batteries or rechargeable batteries, insofar as the defect is due to normal wear;
- damage caused by incompatible third-party products, software, power supplies, cables or accessories;
- commercial or industrial use outside the intended product purpose;
- removed, altered or illegible serial numbers or product markings.
The warranty also does not apply to software, cloud services, apps, external platforms or third-party services, insofar as these are not expressly part of the warranted smartathome branded product.

Relationship to the statutory warranty
This warranty is a voluntary additional service. It limits neither your statutory warranty rights nor your rights under mandatory consumer protection regulations.
In the event of a defect, you can therefore choose to assert either statutory warranty rights against Smart@Home as the seller or claims under this warranty, provided the respective conditions are met.
Liability
Statutory claims, in particular claims under the Product Liability Act, claims for injury to life, body or health, as well as claims based on intentional or grossly negligent conduct, remain unaffected.
